Terms & Conditions

All goods and services ("Goods") supplied by Platypus Puzzles ™ ABN 56 410 376 624 to the customer are subject to the following terms and conditions:

1. Prices

Prices for Goods sold are those quoted by Platypus Puzzles ™ and their distributors. Prices are subject to change without notice.
Unless otherwise stated, all prices for Goods sold Platypus Puzzles ™ are inclusive of GST where applicable.

2. Orders and Payment

The Customer may place an order via the website, telephone, facsimile, e-mail, Facebook or post, or via a Platypus Puzzles ™ distributor
An order will be deemed to have been placed on the date on which it is received Platypus Puzzles ™, however, production will not commence until payment for said order is received in full.
Payments are to be made at the time of placing an order and may be made by PayPal, major credit card, or direct deposit.
Credit may be applied in some situations, and where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including commission on a collection of the additional costs and also including legal demand costs
Upon placing an order, customers MUST ensure they have the correct spelling and wording on the order – any errors that arise from customers will not be covered by the Terms and Conditions as specified in section 4 – Cancellations & Returns
Any orders placed using the wrong pricing selection or not selecting the correct pricing option will be automatically charged to ensure your order price matches what has been ordered.
Orders with choice information omitted on order form will have default selections chosen on your behalf to avoid delaying your order and causing interruptions to production. I.e. colours will default to rainbow and missing shapes will have a basic shape included based on the name provided. Engraving will require contact and if no contact is reached, engraving will be omitted and refunded.

3. Changes to Orders and Contracts

As all orders are custom made, on demand, Changes to orders will only be accepted if contact is made with Platypus Puzzles ™ PRIOR to the commencement of said order.

IT IS THE RESPONSIBILITY OF THE CUSTOMER TO ENSURE ALL SPELLING AND WORDING ARE CORRECT AT THE TIME OF ORDERING (there’s an echo in the room…)

4. Cancellations & Returns

No order may be cancelled except with the written (including e-mail) consent of Platypus Puzzles™; cancellations will only be accepted on terms which will indemnify Platypus Puzzles™ against all losses.
Platypus Puzzles™ agrees to the cancellation of an order or the return of Goods, it may provide the Customer with a credit note for any amounts paid.
All Goods approved for return to Platypus Puzzles ™ must be received by Platypus Puzzles™ with the Returns Form and in prime original resale-able condition and in the original unopened and unmarked packaging. Platypus Puzzles ™ reserves the right to charge the Customer a restocking fee from 10% for any goods so returned.
1. Goods incorrectly delivered by Platypus Puzzles™ will attract no restocking or return freight fee.
2. Goods incorrectly ordered by the Customer, meeting conditions detailed in section 4.3, and if approved for return by Platypus Puzzles™, will attract a restocking fee from 10%. Return freight will be the Customer's responsibility.
3. Personalized goods incorrectly ordered by the Customer (spelling errors) WILL NOT BE ACCEPTED FOR RETURN AT THE EXPENSE OF Platypus Puzzles™
4. If any purchased product does not meet your requirements, subject to section 4.3, Platypus Puzzles ™ will exchange, replace or credit if Platypus Puzzles ™ is notified within 7 days of your receipt of the goods.
Goods supplied to you that are manufactured by Platypus Puzzles™, which are damaged or incorrect;
1. may have the damaged or incorrect portion of the order sent as replacement, at the discretion of Platypus Puzzles™, without requiring the original to be returned to Platypus Puzzles™, OR
2. may have the full product replaced once the original is returned to Platypus Puzzles™ using the RETURNS LABEL provided by Platypus Puzzles™. OR
3. The cost of the omitted 'add-ons' OR up to 20% of the full purchase price (only, not including postage), which ever is the lesser, will be refunded.
4. 4.2 May receive replacement sent earlier via express post, upon confirmation of return postage tracking confirmation received by Platypus Puzzles™

5. Delivery

All Goods:

Customers will incur the cost of delivery unless stated otherwise.
All urgent orders are to be purchased using express post, to avoid delays or disappointment
Orders requested before our listed lead times are not guaranteed however every effort will be made to process in time.
Platypus Puzzles ™ shall not be liable for failure to deliver or for delay in delivery occasioned by any cause whatsoever.
Platypus Puzzles ™ reserves the right to deliver by installments, and each installment shall be deemed to be sold under a separate contract but the failure to deliver any installment shall not entitle the Customer to repudiate any or all of such contracts.
The method of transportation and carrier will be at the selection of the customer, with only registered or recorded delivery available to ensure tracking and insurance is available.

6. Warranty

Except for those required or implied by legislation, Platypus Puzzles™ gives no express warranty in relation to Goods supplied to the Customer, and the Customer acknowledges that it has not relied on any representation or warranty made by or on behalf of Platypus Puzzles™. Certain legislation may imply conditions and warranties into these terms and conditions. To the extent that such conditions and warranties may lawfully be excluded, all such conditions and warranties are expressly excluded.

7. Limitation of Liability

The liability of under or arising out of the supply of Goods for breach of any term, condition or warranty implied in or imposed upon the supply of the goods by legislation, shall be limited, at the option or Platypus Puzzles™ to:
1. if the breach or liability relates to goods:
2. the replacement of the goods or the supply of equivalent goods;
  1. the repair of the goods;
  2. the payment of the cost of replacing the goods or of acquiring equivalent goods; or
  3. the payment of the cost of having the goods repaired;
if the breach or liability relates to services;
1. the supplying of the services again; or
2. the payment of the cost of having the services supplied again.

Except to the extent the law provides that liability is not able to be excluded, Platypus Puzzles ™ shall not be under any liability to the Customer in respect of any loss or damage (including consequential or indirect loss or damage or loss of profits, loss of use or loss of data) however caused, which may be suffered or incurred or which may arise directly or indirectly in respect of the Goods supplied by Platypus Puzzles ™ or the failure of Platypus Puzzles ™ to comply with these terms and conditions.

General

Amendment: These terms and conditions of supply shall not be amended except in writing signed by each of the parties.
Sever-ability: If any provision of these terms and conditions of supply is deemed to be unlawful and unenforceable, such provision will be severed from these terms and conditions of supply and all other provisions of these terms and conditions of supply will remain in full force and effect.
Separate Contracts: These terms and conditions of supply constitute a separate contract in relation to each item of goods ordered or supplied.
Waiver: Any failure by Platypus Puzzles ™ to insist upon strict performance of any of these terms and conditions will not be deemed a waiver of any term or of a breach by the customer.
Copyright: All text, illustrations and photography are subject to copyright and may NOT be reproduced in whole or part, without express permission from Platypus Puzzles ™
Conflicts: These terms and conditions will apply to the exclusion of all other terms and conditions contained in the Customer's order. In the event of any inconsistency, Platypus Puzzles ™ will be deemed, by delivering the Goods to the Customer, to have made an offer to the Customer to sell the Goods pursuant to these terms and conditions, which offer will be deemed to have been accepted if the Customer retains or accepts the Goods. Platypus Puzzles ™ reserves the right to change these terms and conditions at any time.

8. Place of Contract

The law of the State of Victoria shall govern these terms and conditions of supply and the courts of Victoria shall have exclusive jurisdiction in all matters arising herein.

9. On Line Transactions

Security: Platypus Puzzles’ online order service requires that the Customer will register to the website in order to finalise payment. The customer is responsible for the safekeeping of their sign-in name and password and must take all reasonable steps to prevent their disclosure to any other person. The customer understands and agrees that Platypus Puzzles ™ is entitled to rely on the authenticity of the Customer's sign-in name and password being supplied to access any service supplied by Platypus Puzzles ™ or to give Platypus Puzzles ™ instructions on the Customer's behalf. Where the correct sign-in name and password have been entered, Platypus Puzzles ™ may act on any instructions given without further enquiry.
Liability and Exclusions: Subject to complying with the Terms, the Customer will not be liable for loss caused by: fraudulent or negligent conduct by employees or agents of Platypus Puzzles ™ or any other unauthorised transactions where it is clear that the Customer can prove such to Platypus Puzzles ™ satisfaction.
The Customer is liable for all losses if the Customer has acted fraudulently at any time, either alone or together with any other person, in using Platypus Puzzles’ online order service. The Customer is also liable for losses where any act or omission of the Customer’s has contributed to causing those losses.
Availability of Service: Platypus Puzzles ™ has made all reasonable efforts to ensure that Platypus Puzzles’ online service will be properly provided to the Customer. However, Platypus Puzzles ™ does not guarantee that these services will be error-free, uninterrupted, continuously available, or free from viruses or malicious programmes.
Links to Other Sites: For the Customer's convenience, the Company's online service and other online services may provide links to other websites, over which Platypus Puzzles ™ has no control. The Customer agrees that Platypus Puzzles ™ has no responsibility for the availability of those sites and that Platypus Puzzles ™ has no liability for and does not endorse any content, advertising, products or services available from such sites.

10. Privacy

Platypus Puzzles ™ respects your privacy and is committed to protecting it in accordance with the Australian Privacy Act 2001 and its privacy principles.
All personal information collected and stored by Platypus Puzzles ™ as a result of your order is used by Platypus Puzzles ™ only for the purposes of facilitating the supply of products and services to you, the customer and servicing our relationship with you. It is not disclosed to any third party, except where the customer has authorised disclosure to a third party e-commerce facilitator.
Customer contact information may also by used by Platypus Puzzles ™ for some direct marketing purposes.
Cookies generated by the use of Platypus Puzzles ™ are used only to validate access to the online ordering system. They are not used to identify individuals, nor used to track navigation patterns, or the address of the website from which a customer may have entered our website.
